Illegal migrants 'could face ban'

20 March 2008 16:21

Non-EU workers found to be illegally working in the UK could face a ten-year ban, it has been claimed.

According to reports, potentially forthcoming proposals could see the introduction of new legislation permitting a ban, despite the first tier of the new immigration system outlining provisions for visa-less employees to visit the UK for the purpose of business.

Under recently introduced legislation, any employer found to have employed a worker illegally can face either a custodial sentence, or a fine of up to £10,000, reports Personnel Today.

"If you come to the UK for business, and plan to work, without a visa, you could be in breach of the law and face a ban of up to ten years," said Phillip Trott, a partner at legal firm Bates, Wells and Braithwaite.

"If [an employee] plans to work at all. We would advise you to apply for a visa, rather than face the consequences."

Under the new points-based immigration process, points are awarded for a number of different criteria, including education and age.
